Sir Maurice Linford Gwyer, K.C.B., K.C., First Parliamentary Counsel. ******** From Time Magazine Monday, May. 03, 1943 From his bench in New Delhi last week India's Chief Justice SirMaurice Linford Gwyer handed down a bombshell decision: Mohandas K.Gandhi, Pandit Jawaharlal Nehru and 8,000 other Congress party leaderswere being illegally detained by the Viceroy's Government. Reason:Rule No. 26, of the Defence of India Act, under which the Congressleaders were arrested and have been held without trial since lastAugust, was invalid because 'it went beyond the powers which theLegislature thought fit to confer on the Central Government.' Crux of Chief Justice Gwyer's decision was that numbers of prisonersin India may have been arrested on the slimmest of evidence. He ruled:'There is no power to detain a person because the Government thinksthat he may do something hereafter or because it thinks that he is aman likely to do it; there must be suspicions based on reasonablegrounds that he is actually about to do it.' Chief Justice Gwyer's decision made the behavior of the British Raj inthe past nine months look not quite Marquess of Queensberry. But itbrought no change in the status of the arrested Congress leaders. The India Office in London plunked the fizzing bombshell in a pail ofwater, announced that the law will be revised to fit the punishment. ******* From The Times Obituary Notice Sir Maurice Gwyer, Education and the Law, The Times of 13 October 1952 Sir Maurice Gwyer, G.C.I.E., K.C.B., K.C.S.I., who died suddenly athis home at Eastbourne yesterday at the age of 74, was the first ChiefJustice of the Indian Federal Court and for many years Vice-Chancellorof Delhi University. A brilliant career in law and education is thus ended. His scholarshipand legal and administrative abilities combined to make him anoutstanding figure from his entry into Whitehall in 1912, and when, in1936, the difficult post of Chief Justice of the Indian Federal Courthad to be filled it was generally recognised that a wise choice hadbeen made, though he had had small success at the Bar, and no previousjudicial experience. It was felt, moreover, that no one was morefitting to construe the India Act of 1935 than its principaldraughtsman. Maurice Lindford Gwyer was the eldest son of the late John EdwardGwyer and was born on April 25, 1878. He was educated at Westminster(he had served as a member of its governing body since 1936) and atChrist Church, Oxford, where he was a Fell exhibitioner. He took afirst in Classical Moderations in 1899, and a second in LiteraeHumaniores in 1901. In the following year he was elected a Fellow ofAll Souls. This election was remarkable inasmuch as the twocompetitors, Gwyer and the late Raymond Asquith, were both thought sohighly of by the examiners that, although only one fellowship wasactually in competition, the exceptional step was taken of awardingone to each candidate. Gwyer was called to the Bar by the Inner Templein 1903, obtaining a first class in the final examination and theCouncil of Legal Education's prizes for constitutional and criminallaw, evidence and procedure. He was a pupil of the late F.D.(afterwards Lord Justice) MacKinnon. Later he was in chambers with thelate F.T. Barrington-Ward, a future metropolitan magistrate, andjoined the Western Circuit, but he never succeeded in acquiring anylarge practice. Though in after years, if given the right topic, hecould make a graceful after-dinner speech, he had little forensicability. In 1912, when a solicitor was required for the Insurance Commission,he entered official life. In 1917 he became legal adviser to theMinistry of Shipping, and at the end of the war - what is notgenerally remembered - he returned to the Bar, and obtained a certainamount of work in the Commercial Court. In the meantime he had beenappointed to the Lectureship in Private International Law at Oxford.He became the legal adviser to the Ministry of Health in 1919. On thedeath of the Hon. Clive Lawrence, in 1926, he succeeded him asSolicitor to the Treasury and King's Proctor, taking silk in 1930. Hesucceeded the late Sir William Graham-Harrison in the arduous andresponsible post of First Parliamentary Counsel to the Treasury in1933. In this capacity it fell to him to draft the great India Bill. Thoughin no way responsible for the policy underlying the measure, which wasthe subject of keen controversy both here and in India, Gwyer wasunderstood to have played a very important part in framing its finalform, and for such success as the 1935 Act had he is entitled to alarge share of the credit. It was on the basis of the 1935 Act thatIndia and Pakistan became independent in August 1947, for it remainedin force, subject to amendment, pending the framing of theconstitutions of those countries, a process which in respect of Indiaoccupied the Constituent Assembly nearly three years. Behind anapparently rather indolent manner and method of work lay a power ofgrasping at sight the essentials of a subject and expressing it in theclearest language, and Gwyer will certainly be remembered as one ofthe greatest draughtsmen of his generation. He was a member of theIndian States (Financial) Inquiry Committee in 1932, and in 1930 hadbeen the first British delegate at The Hague Conference on theCodification of International Law. Gwyer hd in the course of his official career assisted the Governmenton many commissions and enquiries. He was a member of the RoyalCommission on London Squares in 1927. He assisted in 1928 at theInquiry held into the conduct of a promiment member of the staff ofthe Foreign Office with allegation of improper speculation in Germanmarks, and in 1936 he was a member of the board which was set up,after the libel action of Lambert v. Levita, to inquire into theadministration of the staff of the B.B.C. It cannot truly be said that Gwyer's reputation was greatly increasedby his tenure of the post of Chief Justice of India; but for this hecan hardly be blamed, as for the first few years of its creation theFederal Court had practically no work to do and Gwyer was able todevote his interest to Indian education and especially to the affairsof the University of Delhi, of which he had been appointedVice-Chancellor. By the time that Gwyer's successor, Sir PatrickSpens, had been selected in November 1942, the Defence of India Rules,passed owing to war conditions, had done something to justify theexistence of the Federal Court and give its members something to do. Gwyer retired from the Federal Court in April 1943, under the agelimit of 65 - some 10 or 15 years later than it was customary forBritish members of the services to leave India. He was already amartyr to arthritis and might well have sought the temperate climateof his native land instead of further enduring the heat of the Delhiplains. But having accepted the post of Vice-Chancellor of DelhiUniversity, he remained in India another seven years to press tocompletion his plans to make the university in every way worthy of itsall-India claim as the metropolitan seat of learning. He had alreadyrescued it from the neglect and obscurity into which it had fallen,and the task he fervently pursued was helped by the great influence hehad with the Indian leaders as an undeviating friend of the ideals ofindependence. He set his face against student pressure for thelowering of standards and the tendency to indiscipline which havehampered the work of some Indian universities. As a septuagenarianVice-Chancellor he had the satisfaction of seeing spectacular buildingprogress on the new site in the grounds of the old Viceregal Lodge,and St Stephen's College already transferred there. Returning to this country in the spring of 1950 he lived atEastbourne, and as he had to use an invalid chair could seldom travelfar to meet old friends. His publications included the twelfth to thesixteen editions of Anson's Law of Contract, and of volume I of thesame author's Law and Custom of the Constitution. He was alsoresponsible for theseventh edition of Pollock and Mulla's IndianContract Act. He married, in 1907, Alsina, the eldest daughter of the late Sir HenryBurdett, K.C.B., K.C.V.O., and sister of the late Osbert Burdett, theauthor. They had a son and two daughters.
